作为法律原则的相互原则:从国际水道法及中国跨界水条约实践探究相互原则的作用

  作为社会交往中的基本现象与国际法中的基本法律原则,相互原则的重要性再怎么强调也不为过。有鉴于此,本文拟首先明确相互原则在国际法中的作用,并基于此审慎地分析其对国际水道法产生的影响。通常,可以从三个层面理解相互原则在国际法中的功能:第一,作为一种发展国际法的机制;第二,作为一种条约机制;第三,作为一种争端解决与实施机制。与这三个层面分别对应,相互原则在国际水道法中发挥着如下作用:第一,将限领土主权原则确立为习惯国际法;第二,明确实体规则中相应的权利与义务;第三,考虑到跨界水领域中更强调争端的避免,而非规则的遵行,相互原则还进一步推动着程序与争端解决规则的发展。具体而言,在相互原则的作用下,一国所提出的诉求也能够被其他国家主张,这就有效抑制了一国提出过分且不合理的主张的可能性。通过这种作用机制,相互原则推动着习惯国际法的发展。“公平合理利用”和“避免重大损害的义务”这两大实体规则经常被认为偏袒着上游或下游国家一方。然而,我们明显可以看到它们实际上规定了具有相互性的权利与义务,以保证法律适用者对它们的解释并不会偏好上游或下游的任一沿岸国同理的,与实体规则相辅相成的程序规则,如信息互换事先通知...
