欺骗性供词及其法律心理语言分析

　　犯罪嫌疑人供词的真实性通常决定着案件能否成功破获，因此，在讯问中识别犯罪嫌疑人是否在撒谎十分重要。本研究从法律心理语言学的角度入手，首先探讨了导致犯罪嫌疑人撒谎的心理原因和伴随撒谎的心理过程，并发现这些心理动因及过程在犯罪嫌疑人的言语中会有所体现。通过梳理前人对欺骗的语言线索的研究，我们整理出了最为常见的几类欺骗的语言线索。以Vrij研究欺骗心理及其语言线索的模式为基础，我们建构了一个分析框架，用于揭示欺骗心理与欺骗的语言线索之间的关系。由畏罪心理派生出的侥幸心理和抗拒心理是导致犯罪嫌疑人撒谎的直接心理原因；犯罪嫌疑人在撒谎的过程中同时经历三个心理过程，即情绪、内容复杂性和行为控制的心理过程。这些心理动因和过程在供词的语言中都有所体现。这些语言线索有着以下特性：较高的间接性，消极性，较低的复杂性和具体性，以及不相关性。本研究发现并探讨了十一种具体的欺骗语言线索。我们依据上述三个心理过程将这些语言线索分成了三类，即情绪类、内容复杂类和行为控制类。本研究通过对二十二篇虚假供词语篇的分析发现：五种欺骗的语言线索出现的频率显著高于其他线索；这五种语言线索在虚假供词中同时出现的情况清楚地揭示了撒...
