中国律师辩护词中情态的说服性研究

　　本文主要从语用学角度对律师辩护词中情态的选择进行了研究。旨在通过对30篇公开发行的各类律师辩护词的描述性分析,发现常用情态的类型和律师选择特定情态的动机,并揭示情态是如何实现其说服作用的。 本文的理论框架是以Verschueren的顺应论为基础,在分析语料的基础上建立起来的。在此理论框架下情态被解释为,对命题或者句子结构起到修饰或者润色的各种语义成分,可以表达肯定或者怀疑的程度、模糊性、可能性、必要性、许可和义务等可以表达对话语态度的一类语义成分。结合彭宣维和Halliday对情态的划分,考虑到律师语言的特色,我们把情态分为三类:评论附加情态、情态动词和语气附加语、情态的混合用法。 首先通过对情态类型使用的频数分析,我们发现情态的使用占到语料的44.7%,其中评论附加语的出现频数为12.9%。其次,我们从心理因素和社会因素角度对情态的说服功能作了顺应分析。以上分析表明情态可用来顺应法官对辩护词的评价和正确理解,提高辩护词的客观性,体现律师对某一事件的态度,维护保全律师的信誉度。 我们希望,本文的研究能有助于加深对情态的理解,认识情态对于实现说服的作用;有助于顺应...
