法庭庭审提问的认知解读

本文尝试应用认知语言学中的概念整合理论，对法庭庭审提问进行分析论证，从认知的角度对庭审提问中律师使用的策略进行解读，从而帮助人们深入认识和理解法庭活动中的认知过程。 法律语言学作为一门边缘学科，正逐渐吸引来自跨学科研究者们的注意。而法庭庭审提问作为整个审讯的中心，不可避免地成为法律专家和语言学家的关注焦点。通过对相关文献的调查发现，近二十年来，国内外很多学者(Woodbury,1984; Matoesian, 1993; Conley & O’Barr, 1998; Philips, 1998; Eades, 2000; Liao Meizhen, 2003)从修辞学、社会语言学、会话分析以及语用学等多个不同角度对法庭庭审提问进行了深入研究，并取得了较丰硕的成果。然而，他们更多地是从社会和语用的角度来观察研究庭审提问，很少有人从认知层面对法庭活动的认知机制进行研究探讨。众所周知，在法庭辩论中，律师为了控制对方证人的回答，会使用一些策略。而律师机智的提问与其认知机制密不可分。因此，本文作者尝试使用概念整合理论，对庭审提问进行认知解读。 Fauconnier & Turne...
