【摘要】:住宅是人们日常生活最重要的消费品和投资品之一,,住宅质量状况与人民生命财产安全息息相关。随着我国城市化进程的深入和房地产市场的繁荣,每年有大量住宅工程开工建设,也有大批住宅在市场上交易并投入使用。但长期以来,我国住宅质量状况一直不容乐观,住宅质量事故频频发生。普通消费者虽然关注住宅质量,但却由于缺乏专业知识和设备无法识别住宅质量,导致住宅质量无法被内化到住宅价格中。住宅质量信息在买卖双方间存在严重不对称导致住宅交易市场上存在大量的质量欺诈,房地产开发企业也缺乏保证和提高住宅质量的激励。这些都为住宅质量管理提出了挑战。 传统的住宅质量管理研究更多从建筑市场管理入手,讨论住宅建设过程的质量管理办法,而忽略了住宅交易市场上广泛存在的信息不对称问题。本研究分别从建筑市场和交易市场两方面对住宅质量管理制度进行研究。首先从不对称信息和不公平博弈角度分析住宅建筑市场和交易市场上存在的市场失灵和私法失灵,建立住宅质量政府管理的理论基础。结合信任品理论研究和模型推导,分析住宅产品的信任品特征和市场上存在的质量欺诈,提出建立住宅质量评价和住宅质量信息披露制度是矫正住宅市场不对称信息,提高房地产开发企业住宅质量保证激励的重要途径。从住宅建筑市场角度切入,本研究通过文献梳理国内外住宅质量管理经验和国内现行的住宅质量管理制度,并结合专家访谈和实地调研分析我国当前住宅质量管理制度中存在的共性问题,包括住宅质量管理公法调节的必要性、质量责任分配不合理,质量责任无法落实,对从业人员管理薄弱等;并针对各住宅质量责任主体及参与机构存在的问题进行具体分析,提出建立住宅质量管理履责保证机制是确保质量责任落实的重要途径。其中住宅质量管理履责机制包括激励机制、责任追究机制和信用制度。此外,本文还针对住宅质量管理的政府管理模式、法律调节方式、各责任主体和参与机构存在问题提出了具体建议,包括强化建设单位质量责任,监理回归业主咨询师定位,通过推行质量缺陷保险落实保修阶段质量责任等。
[Abstract]:Housing is one of the most important consumer goods and investment products in people's daily life. The quality of housing is closely related to the safety of people's lives and property. With the deepening of urbanization and the prosperity of real estate market in China. Every year, a large number of housing projects are started, and a large number of houses are traded and put into use in the market. However, for a long time, the quality of housing in China has not been optimistic. Residential quality accidents occur frequently. Although ordinary consumers are concerned about housing quality, they are unable to identify housing quality because of the lack of professional knowledge and equipment. As a result, housing quality can not be internalized into the housing price. The existence of serious asymmetry between buyers and sellers of housing quality information leads to a large number of quality fraud in the housing trading market. The real estate development enterprises also lack the incentive to guarantee and improve the housing quality, all of which pose a challenge to the housing quality management. Traditional residential quality management studies more from the construction market management, discusses the housing construction process of quality management methods. This study studies the housing quality management system from the construction market and the trading market respectively. First of all, the asymmetric information and unfair game are studied. This paper analyzes the market failure and private law failure in the residential construction market and the trading market. This paper establishes the theoretical basis of government management of housing quality and analyzes the characteristics of trust products and quality fraud in the market by combining the theoretical research and model derivation of trust goods. It is proposed that the establishment of housing quality evaluation and housing quality information disclosure system is an important way to correct the asymmetric information in the housing market and to improve the incentive of housing quality assurance in real estate development enterprises. This research combs the domestic and foreign residence quality management experience and the domestic present residence quality management system through the literature, and combines the expert interview and the field investigation to analyze the common problems existing in the current housing quality management system of our country. Including the necessity of regulation of public law of housing quality management, unreasonable distribution of quality responsibility, failure to implement quality responsibility, weak management of employees and so on; And in view of each residence quality responsibility main body and the participation organization existence question carries on the concrete analysis. It is put forward that establishing the accountability guarantee mechanism of housing quality management is an important way to ensure the implementation of quality responsibility, among which the performance mechanism of residential quality management includes incentive mechanism, accountability mechanism and credit system. This paper also puts forward specific suggestions for the government management mode, the legal regulation mode, the main body of responsibility and the participating organizations of housing quality management, including strengthening the quality responsibility of construction units. Supervision return to owner consultant position, through the implementation of quality defect insurance to implement warranty stage quality responsibility.
