CEMAC法对海事承运人海事义务的研究

  海上运输在当今国际贸易中占有重要地位,海商法因此取得了很大发展。世界经济贸易的90%是通过海上运输进行。海上货物运输中海上承运人义务的规则是一套规范海上货物妥善运输的规则。这些义务大部分是由国际公约规定的,并已纳入国家的法律规则。但是,各国都可以制定其立法。与非洲法语国家一样,中非国家元首理事会的一项联合决定也通过1994年12月22日第6/94-UDEAC-594-CE-30号法规而适用海事规则,其第406条对承运人施加了《海牙规则》和《汉堡规则》的规定下的妥善运输的义务。为此,立法者考虑了托运人的利益,并通过2012年7月22日签署的第08/12-UDEAC-088-CM-23号法规对旧法规进行了修订,在其第525条中规定了更多的承运人义务。因此,作为使承运人的权利减至最小的一种手段,应将承运人的义务作为重点,即不仅应在航程开始之前使船舶适航,而且应在整个航行期间保持船舶适航。通过这种方式,可以防止反复出现的不安全状况困扰海上运输行业,并且可以避免由于船舶面对海上风险时不适航而在海上运输中发生越来越多的事故。不适航有时是船舶层面上的原因,可能因船龄导致运输的安全等级很低,还有船员对...
