【摘要】：为了维护公民的合法利益,维护法律程序的公正,提高立法文件翻译质量尤为重要。鉴于条件句在法律规则中占有较大比例,对条件句翻译的研究也就有了更为重大的必要性和意义。随着资源共享、学科间交流交叉增多,法律翻译逐步经历了严格的直译、直译、意译以及某些双语或多语立法国家或地区实行的共同起草。译者不再是机械的转码者,而是被赋有一定的自由。译者的创造性及如何进行创造性成为本文关注的问题。本文以从CLIPS语料库中提取的《劳动合同法》及其双译本为研究对象,从宏观信息层面、微观信息层面以及语言主要是词汇的选择来探究条件句翻译的译者创造性。研究发现,宏观信息结点变动相对较少,译者的创造性主要表现在WB前移、WC后移以及WP前移及WC缺失。WB前移主要受语言规约的影响而WC的变化主要是由于名词化的使用或者由于译者的失误。在微观信息成分层面,体现在信息点的增加、减少、替换和重组,主要受语言规约和法系等的影响。双译本的比较亦发现在对法系以及立法主旨方面中国官方版本更为准确。
